Read this agreement thoroughly and carefully before booking a trip with us.

Agreement: The terms and conditions set forth in this agreement constitute the entire understanding and agreement between you the trip “Participant” and Our Whole Village, LLC “Our Whole Village” with respect to any and all bookings, tours or transactions made with Our Whole Village.

By submitting a booking form and signing this agreement, you accept all of the terms in this agreement and direct us to perform services on your behalf. All persons named in this booking (“Participants”) are subject to this agreement. By signing this agreement, you affirm that you have made all other Participants listed in the booking aware of these terms – regardless of how final payment is made – and that all Participants accept these terms.

Deposits & Final Payment: You are required to pay a non-refundable deposit of $400 per person per trip for your booking to be confirmed. Final payment is due 90 days prior to departure. If your booking is made within 90 days of departure, the entire tour cost must be paid when we confirm the trip with you. Please note that different deposits amounts may be required for selected trips.

Final payment must be made by personal check, cashiers check, or wire. Credit cards are not accepted for final payment.

If full payment has not been received at that time, Our Whole Village reserves the right either to treat the reservation as cancelled or to charge your credit card for the cancellation fees.

The tour price does not include:

  • International or internal flights unless specified
  • Airport transfers, taxes and excess baggage charges unless specified
  • Meals other than those specified in the program
  • Visa and passport fees
  • Travel insurance
  • Optional activities and all personal expenses

Cancellation & Refunds: Notification of cancellation must be made in writing to Our Whole Village. At the time we receive the cancellation, all moneys will be refunded less the following cancellation charges, deducted from the total package price.

  • 90-61 days before departure: 50% of the package price
  • 60 days or less before departure: 100% of the package price

Please note that no partial refunds will be given for unused meals, hotels rooms, airport transfers etc., for any reason whatsoever. Our Whole Village reserves the right to increase the tour price in the event of cost increases due to changes in airfares, currency fluctuation, or fuel changes up to the time of final payment, except for increased government taxes, such as increased park fees, which can be passed on at any time. Our Whole Village reserves the right to alter the tour without notice. Our Whole Village is not responsible for expenses incurred by trip members in preparing for the trip (e.g. visa fees, equipment, etc.) or for any necessary additional travel arrangements should you embark from home before the group departure date. Accommodations are subject to change.

Cancelled Trips: Our Whole Village reserves the right to cancel any departure to protect your safety due to a natural disaster, act of God, act of terrorism, sickness or disease outbreak, or other causes beyond our control. In such a case a refund is given which equals the total payments received less deposit and less all non-refundable expenditures paid to our outfitters. For all other trips cancelled by Our Whole Village each customer will be sent a full refund. In both cases Our Whole Village is not responsible for additional expenses incurred by customers such as non-refundable advance purchase air tickets, visa fees, etc.

Release of Liability & Assumption of All Risk: Our Whole Village, LLC, its employees, shareholders, officers, directors, successors, and assigns (collectively Our Whole Village), does not own or operate any entity which is to, or does provide goods or services for your trip including, for example, accommodations, air or other transportation companies, food service providers, equipment suppliers (local ground handlers, some of whom may utilize the Our Whole Village name in logos, signs, clothing, etc.), etc. Our Whole Village is not liable for any negligent or willful act or failure to act of any such supplier of goods or services, or of any other third party.

I am voluntarily participating in this trip with the knowledge of the numerous risks and dangers involved including but not limited to risks of physical exertion for which I am not prepared; forces of nature; transportation failures whether by plane, train, auto, boat, canoe, kayak, bicycle, ski, horseback or other animal, by foot, or by any other conveyance; consumption of alcoholic beverages; risks associated with food or impure water; risks associated with food allergies and/or medical conditions including, without limitation, the failure of any supplier to adhere to my dietary, medical or allergy related protocols; government actions; civil unrest; terrorism or the threat thereof; criminal activity; dangers associated with or bites from wild or other animals, pests or insects; breakdown of faulty maintenance of equipment; high altitude; accident or illness without access to means of rapid evacuation of availability of medical supplies or services; the adequacy of medical attention if and when provided; epidemics or the threat thereof; and stolen, lost, or misplaced luggage or property. In addition, I accept all risk of and release Our Whole Village from its own negligent conduct. I acknowledge that the enjoyment and excitement of travel is derived in part from the inherent risks incurred by travel and activity beyond the accepted safety of life at home or work and that these risks contribute to such enjoyment and excitement, being a reason for my participation. I hereby agree to be responsible for selecting a trip which my party, I and our doctors believe we are physically and mentally able to undertake and to be responsible for our own welfare and accept any and all risks of delay, unanticipated events, inconvenience, illness, injury, emotional trauma or death.

I acknowledge that the cost of all Our Whole Village trips is based upon trip participants executing this Release of Liability and Assumption of All Risk, and Arbitration Agreement. Therefore, as lawful consideration for being permitted to participate on such trip(s). I hereby release and discharge Our Whole Village from and against any and all liability arising from my participation in the trip. I agree that this release shall be legally binding upon me personally, all members of my family and all minors traveling with me, my and their heirs, successors, assigns, and legal representatives, it being my intention fully to assume all the risks associated with this trip and to release Our Whole Village from any and all liabilities to the maximum extent permitted by law.

Travel Insurance: The tour price does not include travel insurance. We strongly recommend that you purchase comprehensive travel insurance, covering trip interruption and cancellation, baggage, accident/life, evacuation, repatriation and other expenses which might arise as a result of loss, damage, injury, delay or inconvenience occurring to you. You agree to assume all costs of medical care and transportation. As such, we require that you purchase travel-related medical insurance if your current medical policy does not cover you during your tour. We may require proof of coverage.

Travel insurance is mandatory for certain itineraries and should be taken out at the time of booking. In those instances, your travel insurance must provide cover against personal accident, death, medical expenses and emergency repatriation with a recommended minimum coverage of US$200,000 for each of the categories of cover. We also strongly recommend it covers cancellation, curtailment, personal liability and loss of luggage and personal effects. You must provide proof of your travel insurance on the first day of your trip; you will not be able to join the trip without it. If you obtain travel insurance through us you acknowledge that you are satisfied with the level of insurance we have arranged.

Pre-Departure Documentation: It is important that you carefully read all trip-related documents that you receive from us as soon as you receive them. It is your responsibility to contact us if any information is incorrect. We cannot accept any liability if you do not notify us of any inaccuracies within 7 days of your receipt of those documents. This agreement, a waiver of liability and assumption of risk agreement and, if required, a medical statement or certification must be signed and submitted by you. If you fail to submit this and other necessary documentation prior to departure, we reserve the right to treat your booking as cancelled by you and impose the cancellation fees described in this agreement.

Passports and Visas: You are responsible for ensuring that all necessary travel documents are valid and effective and in your possession for the entire tour. Passports are required for all U.S. citizens traveling abroad and should be valid for at least 6 months after your date of return. We suggest you apply for or renew a passport early. Other required documents may include visas, permits, and vaccination certificates. You assume complete and full responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements. You are also solely responsible for any adverse consequences resulting from incomplete or defective documentation. While we may provide information or advice on matters such as visas, vaccinations, climate, clothing, baggage, and special equipment in good faith as a courtesy to you, we are not responsible for any errors or omissions as to the information provided.

Tour Start Date: It is your responsibility to be ready to embark on the tour as specified in the itinerary. Our Whole Village is not responsible for any losses due to cancelled or missed flights, changed flight itineraries, late arrivals, or early departures.

Compliance with Local Laws and Tour Etiquette: You must strictly comply with all local laws, respect local customs and culture, accurately assess your abilities, respect other trip members’ privacy, and follow the suggestions and advice of any assigned guide. The decision of the local guide or local supplier is final on all matters that may threaten the safety or interfere  with the wellbeing of others. During the tour, Our Whole Village or the local guide/supplier has the right in its sole discretion to remove anyone a) who it judges to be incapable of meeting the demands and requirements of participating in the tour activities; or b) who it determines to detract from others’ enjoyment of the tour.

Images Release: I agree that Our Whole Village reserves the right to take photographs or film records of any of its trips. In addition, Our Whole Village may utilize photographs or film records submitted by other trip participants or by third-parties. In all cases, I agree that Our Whole Village may use any such photographs or film records for its own promotional and/or commercial purposes including licensing of same to third-parties, all without any remuneration to me. You grant us a perpetual, royalty-free, worldwide, irrevocable licence to use such images for publicity and promotional purposes.

Medical Proxy: Participant(s) hereby give(s) Our Whole Village, LLC and the suppliers of goods and services for this tour permission to arrange emergency medical treatment for passenger if necessary, and passenger agrees to hold Our Whole Village harmless for the provision, non-provision, or negligent provision of such services.

Health Risks: Medical services or facilities may not be readily available or accessible during all or part of the trip. No doctors or health care providers accompany the group and you agree to assume all risks associated with illness, death, injury or altitude sickness as well as the lack of appropriate and timely medical attention.

Limitation of Remedies: You agree that the sole remedy for any default by Our Whole Village arising under this agreement shall be the return of the paid tour cost. To the maximum extent permitted under applicable law, Our Whole Village shall not be liable for any special, consequential, indirect, incidental or other damages arising out of or in any way connected to this agreement, including lost profits, whether such damages arise in contract, negligence, tort, under statute, in equity, at law, or otherwise, even if Our Whole Village has been advised of the possibility of such damages. You expressly waive any right you may have to recover such damages.

Severability: If any provision of this agreement shall be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render the agreement unenforceable or invalid as a whole. Such unenforceable provision will be replaced with one that is valid and enforceable and which achieves, to the extent possible, the original objectives and intent of the original provision.

Successors and Assigns: This agreement shall inure to the benefit of and be binding upon Our Whole Village and the Participant and their respective heirs, legal personal representatives, successors and assigns.

Updating of Terms and Conditions: Our Whole Village reserves the right to update and/or alter these terms and conditions at any time. It is your responsibility to be familiar with these terms and conditions. The latest terms and conditions can be found on the Our Whole Village website www.ourwholevillage.com/terms-and-conditions

Binding Arbitration: I agree that any dispute concerning, relating, or referring to this agreement, Our Whole Village’s tour brochures or any other materials that concern my tour, the tour itself, or any claim for damages due to property injury, bodily injury or death which occurs during or in connection with my tour, shall be resolved exclusively by binding arbitration. The binding arbitration shall take place in Miami, FL, USA, in accordance with the rules of the American Arbitration Association. Such proceedings will be governed by substantive (but not procedural) Florida law. The arbitrator and not any federal, state or local court or agency shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, conscionability, or formation of this contract, including but not limited to any claim that all or any of this contract is void or voidable.

Merger: This Agreement is the final, complete and exclusive statement of the parties’ agreement on the matters contained in this agreement. It supersedes all previous negotiations and agreements.

I have read this entire agreement, and I am signing it freely. I understand that this is a legally binding contract. No other representations concerning the legal effect of this document have been made to me. My signature applies to all pages of this agreement. All adult travelers are required to sign and date below. Parents must list and sign on behalf of their minor children travelers.

A signed copy must be received before travel documents are sent out.
